How specific situations were handled

The Situation

A family with assets in three countries, no Will, and an ageing parent

An adult son approached us after his father — in his late seventies, resident in Malaysia — expressed concern that his affairs were not in order. The family held residential property in KL and Penang, a Singapore savings account, and shares in a private family company registered in Hong Kong.

What Was Done

Over four sessions, we mapped the asset picture, identified the applicable laws in each jurisdiction, and coordinated with the family's Singapore and Hong Kong advisors. A Malaysian Will was drafted that addressed the local assets, with complementary instruments prepared in the other jurisdictions. A Power of Attorney was executed to allow the son to manage property matters in KL if required.

The Outcome

All instruments were executed within eight weeks. The father expressed that, for the first time, he felt confident his family would not face uncertainty or delay. The son noted that the process had also served as an opening for wider family conversations about the estate that had previously not taken place.

The Situation

An executor managing a contested estate distribution

A client was appointed executor of her father's estate. A sibling contested the distribution, claiming that a subsequent informal document modified the Will's provisions. The estate included residential property, unit trusts, and shares.

What Was Done

We represented the executor through the High Court Probate process, addressed the challenge to the Will's validity, managed the estate accounts through the administration period, and coordinated the IRB tax clearance correspondence before distribution could proceed. Communication was maintained carefully throughout, given the family sensitivities involved.

The Outcome

The Will was upheld. Distribution was completed approximately fourteen months after the date of death. The client noted that, despite the difficulty, she felt supported throughout and was never left uncertain about what was happening or what came next.

The Situation

A testamentary trust for two young children from a first marriage

A client who had remarried wished to ensure that assets accumulated before the second marriage would be held for his children from the first marriage, without complicating the position of his current spouse in the interim period.

What Was Done

We structured a testamentary trust within the Will that ring-fenced specific assets for the children, to vest at age twenty-five. A corporate trustee was appointed alongside an individual protector. The Will also addressed the current spouse's entitlements separately, so that both interests were provided for clearly.

The Outcome

The client found that the engagement had required more thought than he initially anticipated — he found the process worthwhile and said it gave him a clearer sense of his own priorities. The documents were executed within five weeks of the initial meeting.
