These terms govern the use of this website and the general terms under which Pusaka Chambers provides professional legal services. Please read them carefully before engaging our services or using this site.

About Pusaka Chambers

Pusaka Chambers is a Malaysian law firm registered and practising in accordance with the Legal Profession Act 1976 and the rules made thereunder. The firm's principal office is located at Suite 5A, Menara Hap Seng, Jalan P. Ramlee, 50250 Kuala Lumpur, Malaysia.

The firm specialises in non-contentious estate planning for non-Muslim Malaysians and foreign nationals with Malaysian assets, including the preparation of Wills under the Wills Act 1959, the establishment of trusts and Powers of Attorney, and probate and administration matters before the Malaysian High Court and through Amanah Raya Berhad where applicable.

All matters handled by Pusaka Chambers are conducted in compliance with the Malaysian Bar's professional rules and ethical standards, including those relating to client confidentiality, conflicts of interest, and the handling of client monies.

No solicitor–client relationship is created by your use of this website or by the submission of an enquiry through the contact form. A solicitor–client relationship is formed only when a written engagement letter or retainer agreement has been signed by both parties.

Persons with specific legal questions relating to their estate, Will, trust, or probate matter should seek qualified legal advice. We are pleased to advise formally once an engagement has been agreed.

While Pusaka Chambers endeavours to ensure the accuracy of the information on this site, the law may change and particular circumstances may differ significantly from general descriptions. We make no representations as to the completeness, currency, or accuracy of the website's content.

Section 04

Engagement of Services

All engagements with Pusaka Chambers are subject to the firm's standard terms of engagement, which are set out in a separate engagement letter provided to prospective clients prior to the commencement of any work. These website terms do not constitute an offer to provide legal services and do not form part of any retainer agreement.

Pusaka Chambers reserves the right to decline any engagement at its sole discretion, including where a conflict of interest exists, where the matter falls outside the firm's practice areas, or where sufficient information has not been provided to assess the matter properly.

Where Pusaka Chambers has agreed to act, the scope of work, fee arrangements, and any limitations will be set out clearly in the engagement letter. The client is encouraged to raise any questions about the engagement letter before signing.

Anti-money laundering obligations under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLATFPUAA) require Pusaka Chambers to conduct customer due diligence on all new clients. Engagements may not proceed until this process is complete.

Section 05

Fees and Payment

The fee ranges published on this website (Will preparation from RM 1,750; Trusts, Powers of Attorney & Living Arrangements from RM 4,100; Probate and Estate Administration from RM 5,550) are indicative only. Actual fees will be confirmed in the engagement letter following an initial consultation at which the scope of the matter is understood.

Published fees do not include disbursements (such as court filing fees, stamp duty, search fees, or charges from third parties) or goods and services tax where applicable. These will be itemised in the engagement letter and in billing statements.

Payment terms, including any requirement for a retainer deposit, will be set out in the engagement letter. Pusaka Chambers issues invoices in Malaysian Ringgit (MYR). Payment may be made by bank transfer to the firm's client account or by such other means as the firm may from time to time specify.

Where a matter is terminated before completion — whether by the client or by the firm — fees will be charged in respect of work properly completed up to the date of termination, together with any disbursements incurred.

Section 06

Confidentiality

Pusaka Chambers takes confidentiality seriously and observes the legal professional privilege and duties of confidence that arise in a solicitor–client relationship. Information disclosed by a client in the course of an engagement will not be shared with third parties without the client's consent, except where required by law or by order of a court.

Information submitted through the enquiry form on this website is not treated as privileged or confidential unless and until a formal engagement is established. You should not submit sensitive personal or financial details through the website form; these may be shared at the first consultation instead.

Pusaka Chambers' obligations under the Personal Data Protection Act 2010 (PDPA) with respect to personal data collected through this website are described in our Privacy Policy.

Intellectual Property

All content on this website — including text, design, graphics, layout, and page structure — is owned by or licensed to Pusaka Chambers and is protected by Malaysian copyright law and applicable international conventions.

You may print or download content from this site for your own personal, non-commercial use. You must not reproduce, distribute, modify, or use any content from this site for commercial purposes without the prior written consent of Pusaka Chambers.

Legal documents prepared by Pusaka Chambers in the course of a client engagement remain the intellectual property of the firm until the applicable fee has been paid in full, at which point ownership of the document transfers to the client in accordance with the engagement letter.

Limitation of Liability

To the extent permitted by applicable law, Pusaka Chambers excludes all liability for losses or damage arising from the use of, or reliance on, the content of this website, including but not limited to any loss arising from decisions made on the basis of general information published on this site.

Where Pusaka Chambers has been formally engaged, the firm's liability to a client is limited to the extent set out in the engagement letter. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other matter in respect of which liability cannot be excluded or limited by law.

Pusaka Chambers maintains professional indemnity insurance as required by the Malaysian Bar. Details of coverage are available on request during the engagement process.

This website may contain technical inaccuracies or typographical errors. Pusaka Chambers reserves the right to correct any such errors at any time without notice.

Complaints and Disputes

Pusaka Chambers is committed to handling all client matters carefully and professionally. If you are dissatisfied with any aspect of our service, we ask that you raise the matter in writing to the supervising solicitor named in your engagement letter in the first instance. We will acknowledge your complaint within five working days and seek to resolve it within 30 days.

If a complaint cannot be resolved internally to your satisfaction, you may refer the matter to the Advocates & Solicitors Disciplinary Board or the Malaysian Bar's Complaints Committee, depending on the nature of the complaint.

Any dispute arising from or in connection with these terms or the use of this website that cannot be resolved amicably shall be referred to and determined by the courts of Malaysia, whose jurisdiction both parties agree to accept.

Section 11

Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising in connection with these terms shall be subject to the exclusive jurisdiction of the Malaysian courts, and both parties consent to that jurisdiction.

Where these terms are accessed from outside Malaysia, local laws may also apply. Users outside Malaysia are responsible for ensuring that their use of this website complies with any applicable laws in their own jurisdiction.

Changes to These Terms

Pusaka Chambers reserves the right to amend these Terms & Conditions at any time. Any changes will take effect from the date on which revised terms are posted on this website. We recommend that you review this page periodically to remain informed of the current terms.

Your continued use of this website following any revision constitutes your acceptance of the revised terms. Material changes that affect ongoing client engagements will be communicated directly to affected clients.

The date at the top of this page indicates when these terms were last reviewed and updated.
