Questions we are often asked

What happens if a Malaysian passes away without a Will?
For non-Muslims, the Distribution Act 1958 sets out how an intestate estate is divided among surviving spouse, children, and parents in fixed proportions. This may not reflect the deceased's actual intentions. The process of obtaining Letters of Administration without a Will is also generally more time-consuming than Probate of a properly executed Will.
Does a Will cover my EPF savings and insurance nominations?
Not directly. EPF savings pass according to the nomination registered with EPF, not according to a Will. Similarly, Takaful and conventional life insurance policies with nominated beneficiaries pass outside the estate. A Will should be understood alongside — not in isolation from — these existing nominations. We explain how each instrument interacts during the consultation.
How long does it take to prepare a Will?
A straightforward Will can be drafted after one initial consultation and executed at a second session, typically within two to three weeks of the first meeting. More complex estates involving trusts, multiple jurisdictions, or corporate interests may take longer, as the document should reflect considered instructions rather than hasty ones.
Can I make changes to a Will after it is executed?
Yes. A Will can be changed at any time while the testator has capacity by means of a Codicil (for minor changes) or by revoking the existing Will and executing a new one. We recommend reviewing a Will after significant life events — marriage, the birth of children, acquisition of major assets, or changes in the family's circumstances.
What is a testamentary trust and when is one appropriate?
A testamentary trust is one established within a Will that takes effect upon death. It is commonly used to hold assets for minor children until they reach a specified age, or to provide for a beneficiary who may not be in a position to manage a lump sum independently. The terms of the trust — trustees, investment powers, distribution conditions — are set out in the Will itself.
How long does Probate take in Malaysia?
Timelines vary depending on the complexity of the estate, whether there are disputes, and court scheduling. An uncontested Grant of Probate at the High Court may take several months from filing. Estates with more complex asset profiles or creditor matters will take longer. We will give you a realistic view of the timeline at the outset rather than an optimistic one.
