What you have built
deserves a considered plan.
Pusaka Chambers works quietly alongside individuals and families in Malaysia to prepare Wills, establish Trusts, and navigate Probate — at a pace that suits the gravity of the subject.
Three areas of careful work
Each engagement begins with a private conversation, not a form. We take notes, and you take your time.
Preparation of Wills
(Non-Muslim)Drafting and execution of a Will under the Wills Act 1959 for non-Muslim Malaysians and foreign nationals with Malaysian assets. The process opens with a private conversation about family circumstances, assets, and your own wishes — no forms at first.
- Initial private consultation
- Careful drafting and walkthrough
- Witnessing and secure storage
- Coordination with overseas counsel
Trusts, Powers of Attorney & Living Arrangements
Advisory and drafting on vehicles used alongside a Will — private family trusts, testamentary trusts for minor or vulnerable beneficiaries, Powers of Attorney for property and financial matters, and representation in the event of incapacity.
- Labuan and onshore trust options
- Trustee and protector appointment
- Coordination with corporate structures
- Measured sessions at your pace
Probate, Letters of Administration & Estate Administration
Representation of executors, administrators, and beneficiaries through the court process, from Grant of Probate or Letters of Administration through to the final distribution of the estate.
- High Court petition and filings
- IRB tax clearance correspondence
- Estate accounts and creditor notices
- Measured support for families in bereavement
A conversation costs nothing.
Leaving matters unrecorded can cost a great deal.
We are happy to meet in our Kuala Lumpur office or correspond at whatever pace suits you. There is no obligation to proceed at the first meeting.
What we attend to carefully
Understanding Malaysian law
We work within the Wills Act 1959, the Distribution Act 1958, and the Inheritance (Family Provision) Act 1971, and explain how each interacts with EPF nominations, Takaful, and Tabung Haji.
Conversations before documents
We do not begin with a form. We begin with a conversation about family, assets, and intentions — because the document must reflect the person, not the other way around.
Cross-border asset coordination
Where overseas assets are involved, we liaise with foreign counsel so that a Malaysian Will sits sensibly alongside arrangements in other jurisdictions.
Measured support in bereavement
Families managing an estate after a loss are met with steadiness and discretion. Communication preferences are set from the outset and respected throughout.
Protecting vulnerable beneficiaries
Testamentary trusts and carefully drafted Powers of Attorney ensure that minor children, elderly dependants, and others with special circumstances are properly provided for.
Secure storage and continuity
Executed Wills are kept in secure storage with clear arrangements for access by executors when the time comes. We do not lose track of what we hold.
Questions we are often asked
What happens if a Malaysian passes away without a Will?
Does a Will cover my EPF savings and insurance nominations?
How long does it take to prepare a Will?
Can I make changes to a Will after it is executed?
What is a testamentary trust and when is one appropriate?
How long does Probate take in Malaysia?
